1 Acceptance of Terms

By creating an account, accessing, or using Atlas AI, you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you are under 18, you may use the Service only with the consent of a parent or legal guardian, and you may not access adult-only features. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2 Account Registration

To access certain features, you must create an account with accurate, complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. Atlas AI is not liable for losses arising from unauthorized account access.

3 Age & Access Tiers

Atlas AI offers family-friendly services that are available to users of all ages. The platform's core features — text generation, image creation, research assistance, and general AI interaction — do not require age verification and are suitable for general audiences.

Adult-themed content (NSFW) is restricted behind three separate gates, all of which must be satisfied before access is granted:

• Age Verification: You must complete identity verification confirming you are at least 18 years of age. Atlas AI supports verification through ID.me or manual document review.
• NSFW Toggle: After successful age verification, you must explicitly enable the NSFW toggle in your account settings. Adult content is never shown by default.
• Paid Membership: Adult content generation requires an active paid subscription (Pro or Elite plan). Free (Starter) accounts cannot access NSFW features regardless of verification status.

4 Acceptable Use

You agree to use Atlas AI responsibly and lawfully. The following guidelines govern acceptable use of the platform:

4.1 Permitted Use

• Creative content generation including text, images, and video for personal or commercial use
• Research, education, and exploration of any topic in an academic or informational context
• Adult-themed content generation (text, images, video) involving consenting adults aged 18+, available only to verified and paid users with the NSFW toggle enabled
• Open conversation and inquiry on any subject without artificial censorship barriers
• Educational research into sensitive topics (including chemistry, physics, history of warfare, explosives, etc.) when pursued in a genuine learning context

4.2 Prohibited Use

• Child Sexual Abuse Material (CSAM): Any content depicting, describing, or requesting sexual content involving minors is absolutely prohibited. This includes AI-generated imagery, text, or any media depicting individuals under 18 in sexual situations. This is a zero-tolerance policy. Violations will be reported to the appropriate law enforcement authorities, including the National Center for Missing & Exploited Children (NCMEC).
• Celebrity Deepfakes: You may not use Atlas AI to generate non-consensual intimate or defamatory imagery, video, or audio of real public figures or celebrities. Creating fake pornographic content of real, identifiable individuals is strictly prohibited.
• Revenge Pornography: You may not use the Service to create, distribute, or facilitate non-consensual intimate imagery of any real person. This includes generating explicit content using someone else's likeness without their consent.
• Defamation: You may not use Atlas AI to generate content intended to defame, harass, or damage the reputation of any real person, whether public or private.
• Direct Harm Instructions: Requests for specific, actionable instructions on how to harm, injure, or kill specific individuals or groups will be flagged for review and may result in account suspension or permanent ban.
• Terrorism and Violence: Content that promotes, incites, or provides operational planning for acts of terrorism, mass violence, or targeted attacks against individuals or infrastructure.

4.3 Flagged Content and Review

Atlas AI employs content monitoring for safety purposes. Certain categories of requests, including but not limited to queries about weapons manufacturing, explosives, harmful substances, and targeted violence, will be automatically flagged for human review. Flagged content does not automatically result in account action. Our review team evaluates context:

• Educational and research inquiries conducted in good faith (e.g., "How do explosives work?" in a chemistry context) are generally permitted, as learning about these topics is not illegal.
• Requests that appear to seek actionable instructions for causing real-world harm (e.g., "How do I build a bomb to use at [specific location]?") will result in account suspension or permanent termination.
• If your account is suspended or terminated as a result of a content review, no refunds of any kind will be provided. All payments are final.

5 Adult Content Policy

Atlas AI permits the generation of adult-themed content only for users who have completed all three access requirements: age verification (18+), NSFW toggle activation, and an active paid membership (Pro or Elite plan). The following conditions apply:

• All generated adult content must depict individuals who are explicitly 18 years of age or older. Any request involving minors in sexual or suggestive contexts is strictly prohibited and will result in immediate, permanent account termination and referral to law enforcement.
• You may generate adult images and videos from your own uploaded images. By doing so, you represent and warrant that you own the rights to those images or have obtained proper consent from all depicted individuals.
• Adult text content, role-playing, and creative fiction involving consenting adult characters is permitted without restriction, provided the NSFW toggle is enabled and your account meets all access requirements.
• You are solely responsible for any adult content you generate. Atlas AI provides the tools; you bear full legal and ethical responsibility for how you use them.
• Users who have not completed age verification or who are on the free (Starter) plan will not be able to access, view, or generate any adult content. All NSFW functionality is hidden and disabled by default.

6 Intellectual Property

Content you create using Atlas AI belongs to you, subject to applicable laws and the rights of third parties. You grant Atlas AI a non-exclusive, worldwide license to use your inputs solely for the purpose of providing and improving the Service. Atlas AI's software, branding, design, and underlying technology remain the exclusive property of Atlas AI. You may not copy, modify, distribute, or reverse-engineer any part of the platform.

7 Payment and Billing

Certain features require payment via subscription or credit purchase. All payments are processed through our supported payment methods, which may include cryptocurrency. Prices are subject to change with notice. Subscriptions renew automatically unless canceled before the renewal date.

7.1 Refund Policy

• All purchases — including subscriptions, credit top-ups, and one-time payments — are final and non-refundable.
• Cryptocurrency transactions are irreversible by nature. Once a payment is confirmed on the blockchain, it cannot and will not be reversed or refunded.
• No refunds will be issued for any reason, including but not limited to: unused credits, unused subscription time, account suspension, account termination, service changes, or dissatisfaction with the Service.
• By making a payment on Atlas AI, you expressly agree that you are waiving any right to a refund, chargeback, or payment reversal.
• Chargebacks or payment disputes initiated without authorization may result in immediate and permanent account termination.

8 Service Availability

Atlas AI is provided "as is" and "as available." We do not guarantee uninterrupted, error-free, or secure access to the Service. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. We are not liable for any downtime, data loss, or service interruptions.

9 Limitation of Liability

To the maximum extent permitted by law, Atlas AI and its operators, affiliates, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses. Our total liability shall not exceed the amount you have paid to Atlas AI in the 12 months preceding the claim.

10 Indemnification

You agree to indemnify, defend, and hold harmless Atlas AI, its operators, affiliates, and contributors from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11 Privacy

Your use of Atlas AI is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

12 Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnification, and limitations of liability) shall survive.

13 Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
